CONTINUED- Appeal – Interpretation from ZEO

Request: Appealing determination made by the ZEO. Returning case, the ZBA will review with all parties involved along with public comment whether or not to uphold the decision made by the ZEO regarding whether or not an installation of 4x4 post aka “ties” on the ground on the property line owned by the neighboring property at 17 Prospect St. is considered a fence or some type of enclosure by the Village’s definition in their code. This parcel is in the Residential District.

Request: Area Variance(s) - Proposed new construction project needing to be brought into compliance with the need of area variances involving a proposed addition to an existing primary structure and an addition to an existing accessory structure. The variances requested will provide relief to exceeding the required lot coverage, encroaching a required side yard setback for the accessory structure in the rear of the property, and increasing the non-conformity of existing legal non-conforming structures. Located in the Residential District.
