Sale & Public Consumption of Marijuana
in the Village
UPDATE: The Village Board sent the issue to a public referendum. On November 16, 2021, Village voters voted to disallow both marijuana dispensaries and lounges.
The Village Board has a deadline of December 31, 2021 to decide how to regulate retail sale ("dispensaries") and public consumption sites ("lounges") in the Village, as New York State has voted to legalize recreational use. Private consumption of marijuana is now legal in NY State, and is not at issue here.
Here are the basics on what the Village Board needs to decide to do:
Do nothing, resulting in the as-of-right permission for dispensaries and lounges. We must pass local laws and regulations governing the time, place, and manner of the operation of dispensaries and/or lounges, provided such laws or regulations do not make operations unreasonably impracticable.
Pass a local law opting-out of either lounges or dispensaries. We must adopt a local law subject to a permissive referendum on or before December 31, 2021.
Pass a local law opting-out of both dispensaries and lounges, subject to a permissive referendum by December 31, 2021.
Note that opting out in 2021 does not preclude the Village from opting in at a future date.
